Event begins July 1, 2010 and ends at midnight on September 30, 2010. Event subject to all applicable federal, state and local laws and regulations. Claims to be postmarked no later than September 30, 2010. Open to all residents of the Continental US at least 21 years of age on date of entry except employees of TriMega (“Sponsor”), 3M., any TriMega Office Product Dealership or any other participating prize providers, or entities, including advertising agencies (or the affiliates or subsidiaries of any of them) (collectively “Event Sponsors”), and immediate family members or persons domiciled with any such employee. Sweepstakes void in Puerto Rico and where prohibited by law.
PRIZES: Winners are solely responsible for all federal, state, or local taxes, fees, insurance and other costs, expenses and service charges associated with the prize unless expressly included. Winner’s tax obligation may be established upon acceptance of prize and may not, thereafter be eliminated or reduced. Winners must complete, sign and return the required Affidavit of Eligibility and Release (“Affidavit and Release”) within ten (10) days of receiving notification. The Affidavit and Release is provided with notification, which is given by US Mail. If the winner does not complete, sign and return such Affidavit of Eligibility and Release within ten (10) days of notification or otherwise does not comply with these OFFICIAL RULES, that person will be disqualified and will forfeit any Prize. Travel companions must execute and return a companion release, provided with notification, prior to ticketing. Prizes cannot be redeemed for cash, are not transferable or exchangeable. Prize is as follows:
Prize: One (1) Grand Prize Winner will receive a Vespa S 50 4V, (“Vehicle”), approximate retail value (“ARV”): $3199. Grand Prize Winner will be responsible for any additional costs associated with the Vehicle, including without limitation title, tax, license, PDI (pre-destination inspection), registration, shipping, insurance, and any additional accessories and options as agreed to between winner and the authorized Vespa USA dealership location at which the vehicle will be delivered, as determined by Sponsor in its sole discretion. Grand Prize Winner will be responsible for pick-up of the Vehicle at a time and location determined in the sole discretion of Sponsor (Sponsor will endeavor, as a courtesy, to select a dealership close to the residence of the Grand Prize Winner). Grand Prize Winner (or his/her parent/legal guardian, if applicable) are also responsible for shipping organization and shipping charge from the authorized Vespa whereat pick up is scheduled to any other location if Grand Prize Winner is unable or unwilling to accept delivery at such dealership.
Grand Prize Winner must complete all documentation required by Sponsor and Vesap. At time of award of Vehicle, Grand Prize Winner (i) will assume full ownership of and responsibility for the Vehicle; (ii) will be required to sign various documents involving the Vehicle; and (iii) must furnish proof of residence, valid operator’s license as required by the law of the Grand Prize Winner’s jurisdiction of residence and of the jurisdiction of pickup and any required insurance coverage. The Grand Prize Winner is responsible for determining the class of license necessary to legally operate the Grand Prize. Piaggio reserves the right to withhold delivery of the Vehicle if Grand Prize Winner does not comply with the above requirements.
No substitution of prize will be permitted except by Sponsor, which, at its discretion, may substitute a prize (or portion of a prize) of equal or greater value. Prize not transferable or exchangeable and cannot be redeemed for cash or used to pay account balance.
Grand Prize Winner is solely responsible for complying with any applicable federal, state and/or local laws and regulations applicable to the Vehicle, including without limitation registration requirements and operating restrictions. The Internal Revenue Service requires a Form 1099 MISC to be issued and filed for any prize winner if the annual aggregate value of the prizes received is $600 or more. Sponsor will issue a Form 1099 MISC to the Grand Prize Winner for the ARV of the Grand Prize. Federal, State and local taxes are responsibility of each Grand Prize Winner. By entering this sweepstakes, entrant agrees to be bound by all conditions stated in this document. All entrants must be at least 18 years of age to enter, and legal residents of the United States to win. Void where prohibited. All prize claims are subject to your company’s gift acceptance policies. Odds of winning depend upon number of eligible entries received. Tax liability is the sole responsibility of the participant. Winners are responsible for the payment of any and all taxes and/or related local, state, federal or international taxes and/or fees that may apply to winnings. Winner will be notified by telephone, email or registered mail. Sponsor assumes no responsibility for late, lost, misdirected, damaged, illegible, postage-due mail, or incomplete entry forms.
